Furthermore, Tai Lei has set the selling price in a high level comparing with other similar products in the market in order to balance their financial statement. However, it does not help with the cost issue. We suggest that backward integration strategy would be suitable for them. Cafà © Tai Lei Loi Kei has already taken care of their distribution; therefore, they can acquire some of the supplier companies such as the company which provides bread and pork chop. With the implementation of this strategy, they can have better control in the cost of their business and they might lower the price to attract more customers. ii.Develop healthier product Nowadays, people concern their health more than before. The trend of the current environment is tent to buy healthy and green products and company always promotes well-being. However, the products of Cafà © Tai Lei Loi Kei are high calories and fats and itââ¬â¢s not what the current market looks for. According to the W5 and T7, it indicated the need to develop healthier food. For example, Tai Lei can invest a new product which claims at healthiness, such as using organic vegetables, low fat milk, vegetable oil, etc. iii.Expand the business to South East Asia and Mainland China According to the strength 1, 4, 5 and opportunity 2 and the concept of the market development, it discloses that Cafà © Tai Lei Loi Kei have a strong power to expand their business out of Macau. They are successful and have a long history of their business and have already accumulated a well reputation. In addition, they are famous to the South East Asia and Mainland China. Itââ¬â¢s attractiveness to the investors from those countries to invest a new business in there. Moreover, the economy of South East Asia and Mainland China are doing well nowadays, itââ¬â¢s one of the motivators that Tai Lei should expand their business to the two markets. iv.Put more efforts on the advertisement and promotion in existing market In strength 1 and opportunity 1, 2, 3, we suggest Tai Lei can create a new strategy with application of market penetration. Tai Lei owns two branches in Hong Kong and three in Macau. Hong Kong and Macau are popular tourism cities in the world, especially Macau; the number of tourists coming to Macau is increasing rapidly. Moreover, according to the opportunity 2, there is better economy in South East Asia and Mainland China, and the main tourists of Hong Kong and Macau are come from those countries. Advertisement and promotion can help to introduce Tai Lei to those tourists before the company enters to these two new markets. For example, using celebrities to promote the brand and product or distribute coupons via different channels. If Tai Lei put more efforts to do the advertisement and promotion in Hong Kong and Macau, it can attract more consumers and increase the market share. vi.Quantitative Strategic Planning Matrix (QSPM) A QSPM for Cafà © de Tai Lei Loi Kei Acquire supplier companyPut more efforts on the advertisement and promotion in exiting marketExpand the business to South East Asia and Mainland ChinaDevelop healthier product External FactorWeightASTASASTASASTASASTAS Opportunities 1.Increase number of tourists coming to Macau0.1510.1540.6020.3030.45 2.Better economy in Southeast Asia and Mainland China0.1010.1030.3040.4020.20 3.Increase in Macau peopleââ¬â¢s purchasing power0.1020.2030.3010.1040.40 4.Promotion coupons attached in Macauââ¬â¢s official tourist map may help increase awareness0.0530.1540.2000.0030.15 5.Cooperation with the youth correctional institution may help finding manpower0.05-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬ Threat 1.Customers are easy to change another brand to consume pork chop bun0.1020.2040.4010.1030.30 2.Increasing number of competitors in the town selling similar product0.1520.3040.6010.1530.45 3.Increasing amount of rent in Macau may lead Tai Lei suffer0.05-ãâ¬â¬Ã£â¬â¬-ãâ¬â¬Ã£â¬â¬-ãâ¬â¬-ãâ¬â¬ 4.Local people refuse to work in small-middle enterprises0.05-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬Ã£â¬â¬Ã£â¬â¬ 5.Negative comments from online reviews and locals0.0510.0540.2030.1520.10 6.Negative news in Taipaââ¬â¢s flagship store in December 2011 (required to close by IACM)0.0510.0540.2020.1030.15 7.People seek for healthier food and beverage nowadays0.1010.1020.2030.3040.40 Sub Total1.00ãâ¬â¬1.30ãâ¬â¬3.00ãâ¬â¬1.60ãâ¬â¬2.60 Internal FactorWeightASTASASTASASTASASTAS Strengths 1.Old history and reputable brand name0.1010.1040.4030.3020.20 2.Use central manufactory to produce pork chop to ensure same quality and acquired ISO recognition0.05-ãâ¬â¬Ã£â¬â¬Ã£â¬â¬Ã£â¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬ 3.Earning profit every year0.1510.1530.4540.6020.30 4.Attractiveness to investors from South East Asia and Mainland China0.1510.1530.4540.6020.30 5.Strong marketing team to develop new promotional programs and expansion strategies0.1010.1040.4030.3020.20 Weakness 1.Low educational level of all level of the employee0.05-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬-ãâ¬â¬ 2.Lack of manpower0.10ãâ¬â¬-ãâ¬â¬Ã£â¬â¬-ãâ¬â¬- 3.High selling price compares to similar products in the market0.1540.6020.3010.1530.45 4.Limited amount of branches in Macau Peninsula0.0510.0540.2030.1520.10 5.Most products are in high calories 0.1010.1030.3020.2040.40 Subtotal1.00ãâ¬â¬1.252.50ãâ¬â¬2.301.95 Sub Total Attractiveness Scoreãâ¬â¬Ã£â¬â¬2.555.50ãâ¬â¬3.904.55 As the table of QSPM for Cafà © de Tai Lei Loi Kei show that the left two columns are extracted verbatim from the EFEM and IFEM of Cafe Tai Lei Loi Kei and also note that four alternative strategies ââ¬â 1) Acquire supplier company 2) Develop healthier product 3) Expand the business to South East Asia and Mainland China 4) Put more efforts on the advertisement and promotion in exiting market ââ¬â were from the companyââ¬â¢s SWOT Matrix. Moreover, the Attractiveness Score (AS) from1 to 4 is used to reveal each strategyââ¬â¢s attractiveness given the respective external or internal factor, where 4 is the best and 1 is the least attractive. Work row by row in developing the QSPM and decide which strategy is the best for the external or internal factor. After conducted the QSPM, the strategy of ââ¬Å"Put more efforts on the advertisement and promotion in exiting marketâ⬠was highly recommended based on the result of the sum total of the Attractiveness Score from QSPM and it acquired the highest score of 5.50. The second recommendation strategy is ââ¬Å"Develop healthier productâ⬠and the third one is ââ¬Å"Expand the business to South East Asia and Mainland Chinaâ⬠due the priority of the Attractiveness Score, which is 4.55 and 3.90. QSPM can be important information for a firm to make decision of strategies. The strategy of the Attractiveness Score below 3 in the QSPM is not taken into the consideration. The reason of chosen ââ¬Å"Put more efforts on the advertisement and promotion in exiting marketâ⬠as the highly recommend strategy, the Attractiveness Score of this strategy in the sector of external factor, there are twoà opportunities are rated as 4 and two rated as 3 reflecting that the strategy was attractive enough to fulfill those opportunities and one of the opportunities is not related; those opportunities are related to the market trends ââ¬â the chance for increasing sales because the tourists, especially the South East Asian and Mainland China tourists, are flooding to Macau tourism market and the booming economy increase the spending ability of local people as well. In addition, two threats about the competitors become more and more because of the opportunities that they can gain the market share of pork chop bun, besides; two threats related to lots of negative comments, news are appeared on the internet, newspaper and magazine. Therefore, a strategy of ââ¬Å"Put more efforts on the advertisement and promotion in exiting marketâ⬠got the highest score on Attractiveness Score because it can against this situation by create more promotional advertisements and distributed by mass media in order to capture the largest amount of pork chop bun market share, by the way; this strategy can break the negative comments and news as well. The remaining one about the shortage of man power in Macau cannot solve by the firm themselves due to the government policy. On the other hand, in the internal factor, two strengths are rated as 4 and two strengths are rated as 3 to show that Cafe Tai Lei Loi Kei has the ancient and reputation brand name, the ISO recognition and the new hire marketing team so it is attractive enough to get the attention of investors all over the world, besides they had good financial report on earn profit per year. Thus, ââ¬Å"Put more efforts on the advertisement and promotion in existing marketâ⬠can be chosen as a tool to attract more investors so as to expand the pork chop bun market by the promotional advertisement about the ancient and reputation brand name and cooperate with the new hire marketing team, the expanding no longer focus on Macao but Southeast Asia. And one strength does not have any relationship of this strategy. Moreover, one of the weaknesses is rated as 2 and one is rated as 4 related to higher price and do not have enough branches in Macau, so the promotional poster or promote in the travel guide book to emphasis the ancient brand name with ââ¬Å"where to buy instruction that can be a good solution to against the weaknesses which already excited in Tai Lei, furthermore; one of the weaknesses is rated as 3 for the less of healthier food, thus first at all, Tai Lei prove some health product then use ââ¬Å"Putà more efforts on the advertisement and promotion in existing marketâ⬠to do more promotion of the related product. And the other weaknesses are no impacted on this strategy. STRATEGY IMPLEMENTATION i.Acquire supplier company Acquisition is one of the backward integration methods. Cafà © Tai Lei Loi Kei could acquire suppliers such as the pork chop and bread suppliers, etc. This benefits Tai Lei because it eliminates the profit which normal suppliers get from Tai Lei, causing reduction of cost. Upon the acquisition, Cafà © Tai Lei Loi Kei may have to keep all the original staff of the suppliers. However, the organizational culture of the two firms may be different so it becomes difficult for Tai Lei to persuade all staff to have full commitment to the Cafà ©. Remuneration package have to been discussed again in order to retain all experienced staff. ii.Develop healthier product Inventing and creating new flavor products will be a way for Cafà © Tai Lei Loi Kei to survive in the keen competition. Customers are always looking for new products and innovations, especially some healthy food. After the launch of new products, it takes Tai Lei a long period of time to test the market response and to see whether the customers accept the new products or not. Cafà © Tai Lei Loi Kei will definitely bear the risk that the new products do not help them to expand the product line and obtain good response from customers. iii.Expand the business to South East Asia and Mainland China It costs Cafà © Tai Lei Loi Kei a lot to expand a new market, such as some South East Asian countries. They have to spend a lot on marketing campaigns and promotion methods. Tai Lei has to tolerate the heavy marketing expenses and at the same time, bear the risk that the customers from new market do not accept this kind of new products. The marketing strategies with high cost will affect Cafà © Tai Lei Loi Keiââ¬â¢s profit. iv.Put more efforts on the advertisement and promotion in existing market By applying the same concept with the expansion of new market in South East Asian countries, Cafà © Tai Lei Loi Kei has to spend a lot to emphasis more on the marketing effort within the existing markets, Macau and Hong Kong. It will be beneficial for them to focus more on the existing market since it is easier to retain customers rather than attracting new customers. However, the high marketing cost decreases Tai Leiââ¬â¢s revenue at the same time. CONCLUSION Cafà © Tai Lei Loi Kei is a local brand with long history, selling its superior pork chop bun to delight customers with most efforts. According to the interview result and data, we created a brand new vision and mission for Tai Lei. Those interview result includes its internal strengths and weaknesses, external opportunities and threats and many other factors which may affect the future development and performance of Tai Lei. A number of matrixes have been conducted to better analysis the current situation of Tai Lei. After all the matrixes analysis, four strategies have been developed. We suggest Cafà © Tai Lei Loi Kei to adopt these four strategies, in order to further develop and expand its own business and have a more prosperous future.

Issue of Cyberbullying Today
Issue of Cyberbullying Today Cyberbullying Twenty percent of kids cyberbullied think about suicide, and one in ten attempt it. Four thousand five hundred kids commit suicide each year (Laird). Cyberbullying is turning out to be a enormous problem effecting many people. There should be a higher offense for a person who cyberbullies someone. Cyberbullying should be a felony, because it has pushed many people into self harm and committing suicide. Bullying is already a major problem in our society today, when it reaches to the internet then it becomes cyberbullying and it ends up affecting more people. When cyberbullying reaches the internet numerous amounts of people are able to read it. Cyberbullying can occur at anytime and it allows people to harass each other which could even end up in people harming themselves. Also you have to include the other emotions people feel when they get cyberbullied such as feeling depressed and empty because of the harassment they receive. They also feel hopeless as if there is no one they can talk to or feeling of hopelessness because you lost the feelings of friendship. A felony is an extreme punishment because if you get a felony you will , lose the right to bear arms, certain employment opportunities, public social benefits and housing, parental benefits, and even the ability to vote. no laws specifically addressed cyberbullying. But legislators have not been blind to the increasing number o f high-publicity incidents, including tragic results in certain cases (suicides and school shootings, for instance) (cyberbullying). 70% percent of students report seeing frequent bullying online (was your visit to nobullying.com helpful?).cyberbullying gets seen by not just the people that it is directed to but cyber bullying can be seen by anyone on the internet. The world is becoming a cruel place to live because everyone is attacking each other instead of building each other up, and now that we have internet it spreads the problem instead of stopping it.This should not be the way we live instead there should be a more serious consequence then just a slap on the wrist. Cyber bullying should be a felony because a felony is a harsher punishment and when people see they cannot take it any further and will hopefully stop.68% percent of teenagers agree that bullying online is a serious problem (was your visit to nobullying.comhelpful?). Most teens agree that cyber bullying is a major issue that needs to be solve and that some actions should be taken into to stop the increase of cyberbullying because cyber bullying h as become too common to not be doing anything about it. 43% of children have experienced bullying online, and 1 and 4 has had it happen more then once(was your visit to nobullying.com helpful?). That on its own tells you that cyber bullying is a huge problem especially since social media has not been out that long this also shows the progression of it has been extremely rapid. People are intentionally bullying people online because they are either cruel and heart less or they are to scared to do it in person but either way it is unacceptable. You shouldnt have to be rude to people all the time or show them hatred over the internet. This is the reason there should be a higher punishment like a felony for this abuse over the internet that possibly everyone in the world can see. Also 80% of teenagers use a cell phone regularly, making it the most common medium for cyberbullying(was your visit to nobullying.com helpful). Most teens now a days have a smart phone and most likely have some sort of social media that they can get on this does not make it any easier to stop cyberbullying from happening. 97.5% have been online in the previous 30 days, 63% have a cell phone, 42% regularly use Instagram, 33% regularly use Facebook, 15% have been the target of cyberbullying in the previous 30 days (boys: 11.8%; girls: 18.5%), 6.3% have cyberbullied others in the previous 30 days (boys: 6.1%; girls: 6.5%)(cyberbullying facts). this shows that most kids are on social media and using internet in some way and 15% of kids were targeted in the past 30 days this is not a good thing thats why there needs to be punishment to those who are doing this. Know that its not your fault. What people call bullying is sometimes an argument between two people. But if someone is repeatedly cruel to you, thats bullying and you mustnt blame yourself. No one deserves to be treated cruelly. (tips to help stop cyber bullying) Cyberbullying is only the bullys fault because they are the ones who keep perusing to be rude and inconsiderate to someone and it is not a laughing matter anymore. They have to be rude and cruel to make one person feel bad about them selves hurt them selves or even bully them to attempt or even commit suicide. It is best to be able to reach out to some one and be able to talk to someone like a counselor, principal, mother figure, father figure just someone that you can tell how you truly feel. Also if someone is being cyberbullied do not just watch the argument unravel take action and tell a teacher parent about what is happening and to the person who was cyber bullied and see if in anyway shape or form you could help them s o they do not have to go through this struggle alone. If cyber bullying happens to either you or someone you know take action to help and stop cyber bullying immediately so it does not progress any further. At the end of the day cyber bullying is not something to joke about of even think is cute and funny this is really serious and needs to stop immediately thats why the law for cyberbullying should be a felony so after people saw what the punishment is they might double think before they are rude to a person so much that they would want to hurt themselves or even commit suicide. The knowledge gained from block (s) L103, L105, L107 and L109 are important to future Operations Sergeants Major because; we will be able to assist the commander through the process of changing the climate and culture and enabling the unit to become stronger as a team. Kotter Model The Kotter Model comes from the L103 block it is an eight stage model that helps avoid mutual issues that plague the smallest change attempts in an organization. Organizations leaders will lead their organizations through this process in order to have a positive and long lasting effect. A leader cannot prematurely hurdle, bounce or make a serious mistake inside a step by doing any of those would have a destructive effect on a successful accomplishment of change. The stages of the Kotter Model are: (1) establishing a sense of urgency (2) creating the guiding coalition (3) developing a vision and strategy (4) communicating the change vision (5) empowering a broad base of people to take action (6) generating short-term wins (7) consolidating gains and producing even more change (8) institutionalizing new approaches in the culture. This Model guides leaders through the process of attempting to change the climate and culture of an organization; I will explain each stage briefly. In stage one it is vibrant the leader institutes a sense of determination by showing the rewards and significant of change. The second stage leaders must organize and support the adjustment development. By building a resilient support team based on belief and common understanding will encour... ...uraging actions necessary to carry out the vision; and continue to take the organization to a higher level. As we think about visions remember the Armyââ¬â¢s vision and how it has changed a few times over the years and to support the change they came up with Slogans. A vision builder must ensure if you use a slogan it must have meaning, do not use an empty one just to have one. Remember a vision is a key used by Leaders to move their organizations successfully into the future. Conclusion In conclusion I have given details of what I erudite and was taught in the second semester of the academy. The Cask of Amontillado Essay -- Literary Analysis, Allan Poes
In Edgar Allan Poeââ¬â¢s ââ¬Å"The Cask of Amontillado,â⬠the main character, Montresor, leads his enemy, Fortunato, into his catacombs, and there buries him alive by bricking him up in a niche in the wall; Poe gives no actual reason for this except to say that Montresor has been ââ¬Å"insultedâ⬠in some way. In his Science Fiction work ââ¬Å"Usher II,â⬠Ray Bradbury adopts many of Poeââ¬â¢s works in creating his storyââ¬âincluding pieces from ââ¬Å"TCoA.â⬠What separates Bradburyââ¬â¢s work from other authors who borrow works and re-imagine them (Gregory Maguireââ¬â¢s Wicked, Geraldine Brooksââ¬â¢s March, and Peter Carreyââ¬â¢s Jack Maggs, for instance), is that ââ¬Å"Usher II,â⬠in its imaginative way, is trying to be one with its predecessor. Bradbury seeks to retain Poeââ¬â¢s love of the double and the secretive (Gothic mentalities where the reader is meant to be a bit uncertain about what theyââ¬â¢re reading and whatâ⬠â¢s going on) while adding, most notably regarding ââ¬Å"TCoA,â⬠the things Poe never had much care for: a beginning, an end, and reasonââ¬âthus making ââ¬Å"Usher IIâ⬠not only an homage to Poeââ¬â¢s work, but a companion piece whose beating heart lies within the original work. Poe, according to Professor Epstein of the Queens College English Department, wrote for the climax, got you there, and then left; examples of this can be found in ââ¬Å"The Black Catâ⬠and ââ¬Å"The Tell-Tale Heart,â⬠where Poe cuts out right before the cops are about to slap the chains on the narrators, and, as will be illustrated below, in ââ¬Å"TCoA.â⬠In ââ¬Å"The Philosophy of Composition,â⬠Poe writes, regarding the structure of his stories, ââ¬Å"It is only with the denouement [the final revelation showing the outcome, or untying, of the plot] constantly in view that we can give a plot its indispensable air of consequence, or causation, by ma... ...has taken Poeââ¬â¢s ââ¬Å"TCoAâ⬠whole, just as it is, and made it his own by tinkering at the edges, giving it a beginning, and, because the main character has knowable reasons for doing what heââ¬â¢s doing, a proper conclusion that doesnââ¬â¢t leave the reader feeling as if theyââ¬â¢ve been pushed to the top of a mountain and then left there to get down themselves. In ââ¬Å"Usher II,â⬠Bradbury takes Poeââ¬â¢s masked figures and lifts them for the reader (if not for the characters, who need to die because they arenââ¬â¢t familiar with Poe). Bradbury hasnââ¬â¢t stolen Poeââ¬â¢s work, nor has he altered its effect; he has, instead, added his own sly creativity to a master storytellerââ¬â¢s work by expounding upon what was already there. I think that even Poe, who so valued originality, would have been amused by Bradburyââ¬â¢s retelling of his work. (Either that, or lead him down into some dark and dusty catacombs.)
Contract and Offer
Introduction A contract is defined as an agreement enforceable by law. Hence for all contracts there should have an agreement. The agreement arises by one of the parties making an offer and its acceptance by the other party. Both offer and acceptance create an agreement. In simple contract should first contain an offer made by one party to the other. What is an offer? As per Sec 2(a) of the contract act ââ¬Å"When one person signifies to another his willingness to do or abstain from doing anything, with a view to obtaining the assent of that others to such act or abstinence is said to make a proposalâ⬠.The word offer of the English law is synonymous to the word proposal of Indian contract act. The person making the proposal is called the proposer or offeror and the person accepting the proposal is called the offeree. A proposal is an expression of will or intention. A person making the proposal that he is willing to contract on the terms stated in it. The proposal is made to ob tain the assent of the other party to whom the proposal is made. When ââ¬Å"Aâ⬠expresses his willingness to sell motor car for Rs. 10, 000 with a view to get Bââ¬â¢s acceptance to his offer, A is said to make a proposal. How is offer made?Offer is made either by words spoken or by words written. This is an express offer. If A either tells or writes to B that he is prepared to sell his car for Rs. 20, 000 it is an express offer. An offer is made by conduct or behaviour. Then it is an implied offer. For example, A is standing in a queue for getting ticket for a train. Characteristics of valid offer 1)The terms of an offer must be clear and certain or at least capable of being made certain. The terms of an offer must be definite, certain and clear. It should not be indefinite, loose or vague. The vagueness of an offer will not create any contractual relationship. The main reason is that the court cannot say what the parties are to do or expected to do a vague offer does not co nvey what exactly it means. Example:- A agrees to B a hundred tons of oil. There is nothing what so ever to show what kind of oil whether coconut or gingili oil was intended to be sold. Hence the agreement is void for uncertainty and vagueness under section 29 of the contract act. In Taylor Vs Portington A agreed to decorate the room according to present style, the court held that present style is vague and uncertain term and therefore the promise could not be enforced.According to section 29 of the contract act, the agreement in which the term is not certain or capable of being made certain are void and the same cannot be enforced in a court of law. 2)Offer must be communicated to the offeree An offer becomes effective only when it has been communicated to the offeree, otherwise it cannot be known whether the parties are of the same mind. Until an offer is made known to the offeree, he does not know what he has to accept. The offeree must have some knowledge about the offer. Otherw ise any act done by him will not create any contractual obligations. In Fitch Vs Snedakar a person gave information (which would lead to the arrest of the murderers of two policemen) without knowing that an award was offered for it, and claimed the award subsequently. It was held that he was not entitled to the award as he was not aware of the same. 3)An offer must be made with an intention of creating legal obligations The most important characteristic of a valid offer is that it must create legal obligation among the parties, otherwise it is not an offer in the eye of law. An offer will not become a promise unless it is made with a view to create legal obligations. If the parties agree that breach of entire party will not give rise to legal rights there is no contract, even though the offer and acceptance have been reduced into writing. An offer must impose some legal duty on the party making it. An offer to perform social act or an invitation to social affairs are not valid offers in the eye of law, because in such cases there is no intention between the parties to create legal obligation. Example:- A invited B to dinner at his house on a particular day. When B went to Aââ¬â¢s house on the particular day for dinner, A was not available in the house and the dinner also was not ready. In such a case ,B could not enforce it or claim any compensation for expenses incurred by him and inconvenience caused to him by A, because Aââ¬â¢s invitation to dinner did not give rise to a legally binding agreement but is only a social affair. 4)Invitation to an offer is not an offer Quotations, catalogue of goods, advertisements for tender and prospectus of a company are no actual offer. They are mere invitations to offer. In case of an invitation to offer there is no intention on the part of the person sending out the invitation to obtain the assent of the other person to such invitation. Example:-When a merchant sends his quotation, it is not an offer but is only an inv itation on his part of his readiness to transact business on those terms. Similarly mere statement of the lowest price at which the vendor would sell, will not amount to an offer. In ââ¬ËHarvey Vs Faceyââ¬â¢ it was held that mere statement of price is not an offer. 5)Special terms attached to an offer must be communicate When any special terms are to be included in a contract it is the responsibility of the offeror to bring those special terms to the knowledge of the offeree. Otherwise the offeree will not be bound by them.Offeree can be held liable for the non-fulfilment of the conditions only when they have been expressly communicated to him or reasonable notice of the existence of the conditions is brought to his knowledge. Suppose the words ââ¬Ëseek backââ¬â¢ are printed on the face of the ticket and the conditions are printed on the back. In such cases, even if the passenger has not actually read the conditions, he will be bound by them. 6)An offer may be to an indi vidual or to the public at large When an offer is addressed to a definite person or body of persons it is called a specific offer. When it is addressed to the whole world, it is a general offer. In Carlil Vs Carbolic Smoke ball Company, the company has offered advertisement a reward of Rs 100 to anybody contracting influenza after using the smoke ball according to their direction. Mrs. Carlil used it as directed, but still she had an attack of influenza. It was held that she was entitled to the award of Rs 100 as it was a general offer and she accepted it. 7)Offer may be express or implied An express offer is one which may be made by words spoken or written. Example:-A writes to B that he is prepared to sell his house for Rs 2 lakhs. This is an express offer. An implied offer is one which may be gathered from the conduct of the party of the circumstances of the case. If a person hires a taxi car for going from one place to another he thereby undertakes to pay the fare even thought he makes no express promise to do so. So it is an implied offer. 8)Offer must be made with a view to obtaining the assent of the other party An offer must be distinguished from mere expression of intention.Mere enquiry is not an offer. An offer must be made with a view to obtain the assent of the other party. 9)Offer may be conditional An offer can be made subject to a conditional. In that case it can be accepted only subject to that condition. A conditional offer lapses when the condition is no accepted. 10)Offer should not contain a term, the non compliance of which would amount to acceptance One cannot say while making the offer that if the offer is not accepted before a certain date will be presumed to have been accepted.ASSIGNMENT LEGAL ENVIRONMENT OF BUSINESS SUBMITTED BY; SUBMITTED TO; LAHIYA. Do Not Go Gentle to That Good Night by Dylan Thomas Essay
Dylan Thomas was a well-known poet and writer whose poems were very famous, such as ââ¬Å"And Death Shall Have No Dominionâ⬠and ââ¬Å"The Play for Voice.â⬠He was born on 27 October 1914, and he died on 9 November 1953. He was very popular in his lifetime, and he is still known by his works after his death. One of his works that I think is the most significant poem is ââ¬Å"Do Not Go Gentle into That Good Night.â⬠This work had been published about two years before his death ââ¬â 1951, and it is also a part of the collection In Country Sleep. Dylan used the poem to express his feeling while his father was losing health and strength, encouraging his father to hold on to life. The theme of this poem is death. At the first line of the poem, ââ¬Å"Do not go gentle into that good night,â⬠he wants to tell the unknown listeners not to go into that good night. We can easily find a poetic device of metaphor when he used the word night for death. We also have an extended metaphor in which day is life and night is death. The first line is also the title of the poem, repeated four times throughout the poem. The next two lines are ââ¬Å"Old age should burn and rave at close of day/ Rage, rage against the dying of the light.â⬠In the second line, we can see what the poet wants to show us about how the elderly should fight death with their remaining health. In addition, when he says ââ¬Å"Rage, rage against the dying of the light,â⬠he wants to clearly confirm that this is the processing of the age ââ¬â the death of old age. The first stanza is the thesis statement of the poem about aging and death. The first line of second stanza ââ¬Å"Though wise men at their end know dark is right,â⬠the metaphor of darkness is continually used; dark represents death. The meaning of this sentence is the clever men think that we are all going to die ââ¬â itââ¬â¢s totally a natural process. However, at the second line ââ¬Å"Because their words had forked no lighting they / Do not go gentle into that good night.â⬠This sentence has an implication. The ââ¬Å"wordâ⬠in this line is the action of the clever people. The poet shows the unknown listener that though the clever men know that the death of aging is natural, they still try to fight it; they ââ¬Å"do not go gentle to that good night.â⬠This idea is continually developed in the next two stanzas: ââ¬Å"The wild men who caught and sang the sun in flight grieved it on its wayâ⬠and ââ¬Å"the grave men who see with blinding sight.â⬠They still fight against the dying of light ââ¬â the death of aging. In the final stanza, ââ¬Å"And you, my father, there on the sad height,â⬠we know the unknown listener is the poetââ¬â¢s father, and he is dying. The poet by this poem, tries to beg and encourage his father to fight against the ââ¬Å"dying of the light.â⬠The speaker ends the poem by two lines: ââ¬Å"Do not go gentle to that good night / Rage, rage against the dying of the light.â⬠These are also the two lines that were repeated throughout the poem. This poem is one of the famous poems in Dylan Thomasââ¬â¢s collection. The poem not only is an encouragement that tells us not give up but fight against the dying of aging, but also he wants to tell his father not go to the darkness ââ¬â ââ¬Å"Do not go gentle to the good nightâ⬠.
